On 1 May 1998, Part II of the Housing Grants, Construction and Regeneration Act 1996 came into force in England and Wales. This legislation fundamentally affects cash-flow and the resolution of disputes, and will undoubtedly apply to most, if not all, contracts operated by firms active in the building engineering services sector. On 1 October 2011, Part II of the Housing Grants, Construction & Regeneration Act 1996 will be amended in England and Wales by the Local Democracy, Economic Development and Construction Act 2009 (Part 8). These guidance notes have been prepared by the BESA Commercial & Legal Department in order to provide an introduction to the relevant provisions of the Act and to the accompanying Scheme for Construction Contracts - the text of both of which are contained within this publication.
